Terms and Conditions

Steel-MAX Building Systems is a registered trade name of Modular Building Components P/L (ACN 69 169 679, ABN 57 069 169 679).

Steel-MAX Distribution is the registered trade name of G2 Trading P/L (ACN 106 223 107 AFT Kenya Investment Trust ), herein after called Steel-MAX, offers the following terms and conditions of the quotation, supply and sale of its materials, products & systems.

  1. Definition. The terms and conditions referred to in this document relate to any and all items, materials, products & systems supplied by Steel-MAX (the “Goods”), as well as any and all suggested methods of use of those Goods expressed and implied by Steel-MAX in any Steel-MAX publication and on the Steel-MAX web site
  2. Use. It is the responsibility of the customer to ensure that the Goods in this order are suitable for the project and should seek the approval of a qualified building certifier before ordering and using the materials, products, systems and methods suggested.
  3. Application. Steel-MAX does not have knowledge of the project for which the Goods are to be used, including specific site conditions and special loads, which may affect the performance and structural suitability of the Goods. Steel-MAX can not be held responsible for the performance of Goods where used in applications beyond the scope of the Goods, as covered by HR Design Group P/L’s certification.
  4. Price. The prices quoted by Steel-MAX do not include GST or a delivery fee. All prices will remain fixed for 30 days from the time of any quotation and may change without notice after that time. An additional delivery fee is applicable.
  5. Delivery. Is made by our separate delivery agents, to the serviced areas covered by those agents. Customers requiring goods to be supplied to un-serviced areas may arrange for goods to be supplied to a serviced location, where they can take delivery. Some goods may be dispatched from different locations and may be delivered to the shipping address at separate times. Steel-MAX endeavours to dispatch Goods within 3 working days from the time of order and relies on its delivery agent to deliver the Goods to the customer’s shipping address as expressly as they can thereafter. Steel-MAX is bound by the delivery agent’s delivery terms and procedures once Goods are consigned to them and transfers all delivery responsibility to them. Any additional costs incurred by the delivery agent as a result of difficulties in delivering the Goods, which are due to problems relating to the customer’s shipping advice, waiting time and/or location conditions, will be charged to the customer.
  6. Retention of title. Steel-MAX reserves the right of ownership of the Goods until receipt of payment in full, from the customer.
  7. Payment. Payment is to be made in full, before despatch of Goods, unless arranged otherwise. All purchases are deemed to be made from our Brisbane QLD store under the common laws of QLD.
  8. Acceptance of goods. The customer shall examine the goods immediately on delivery and shall be deemed to have accepted that the goods are of the description, quality and quantity ordered, unless Steel-MAX is notified of particulars of any discrepancy in writing within three working days after the delivery. Steel-MAX shall not be liable for any claim for damaged goods or goods alleged to be not of the description, quantity or quality ordered, unless duly notified and as is mandatory by law.
  9. Warranty and replacement. Steel-MAX warrants that the goods supplied are manufactured to comply with the relevant Australian Standard Codes and are suitable for use in the application referred to in the product information notes and documents published by Steel-MAX on the web site and in other associated Steel-MAX publications. Steel-MAX will replace any damaged Goods and make good any discrepancy in quantity of any Goods found to be missing from the customer’s order at its own expense.
  10. Cancellation of Orders. Cancellations must be made in writing and Steel-MAX must receive written notification by mail, email or fax prior to despatching the Goods. Any costs incurred as a result of the cancellation will be charged to the customer.
  11. Returns. All goods returned shall be returned at the discretion of Steel-MAX and will be subject to a handling charge of 20% of the value of Goods. Any costs incurred to return goods to the place of despatch are at the buyer’s expense. Goods and packaging must be in original condition, free from damage and blemishes.
  12. Amendments. These terms and conditions remain current at the time of purchase, however; Steel-MAX reserves the right to alter or change these terms and conditions at any time and without notice. Any transactions with Steel-MAX will be done as per these trading terms and conditions at the time of the applicable transaction(s) – It is recommended you print these terms and conditions at the time of purchase or payment for any goods ordered.
